La dichiarazione di cui al modulo C deve essere redatta solamente dai componenti del gruppo di progettazione, consulenti e collaboratori riempiranno gli appositi spazi dell'allegato B "Domanda di partecipazione alla preselezione".

Quesito 44

Nel caso partecipi al concorso una società, una srl, una volta inserito il riferimento del legale rappresentante, è necessario anche inserire i riferimenti "del gruppo"?

E' sufficiente la società che partecipa al concorso, in quanto la società deve possedere i requisiti per la partecipazione al concorso di cui all’art. 90 del D.Lgs. 163/2006.

Quesito 45

Tutti i membri del gruppo devono avere una partita iva?

I professionisti che costituiranno il gruppo di progetto, dovranno essere abilitati a firmare il progetto, parti di esso di loro competenza, o quantomeno gli studi e le indagini che fanno parte del progetto stesso. Professionisti che non possiedono tali abilitazioni, potranno figurare come consulenti o collaboratori ai sensi di quanto previsto dal punto 2.3 del bando. Ne consegue che la necessità o meno di determinati requisiti è legata alla conformazione che si intenderà dare al gruppo di progetto.

Quesito 46

In caso di ricorso all'avvalimento, previsto dall'art. 46 del D.Lgs 163/2006, le competenze apportante dal soggetto ausiliario possono essere comprese nell'illustrazione delle 5 opere e/o progetti più rappresentativi? Oppure possono unicamente essere comprese nei requisiti di cui alle competenze e al curriculum?

L’avvalimento è riferito a lacune dovute alla mancanza di requisiti speciali e non può essere utilizzato per colmare aspetti sottoposti a valutazione da parte della giuria quali curriculum, opere e progetti.

I lavori presentati come portfolio possono appartenere ad uno studio non presente nel raggruppamento ma nel quale uno dei membri ha lavorato in una sua precedente esperienza lavorativa?

I progetti presenti nel dossier, di cui all'art. 3.1 del bando di concorso, dovranno appartenere ai componenti del gruppo di progetto.

All'interno degli elaborati A3 del dossier di presentazione (rispettando il numero di pagine per ciascuna sezione indicata nel bando), è possibile inserire anche delle immagini nei fogli riportanti:
1) "curriculum professionali e scientifici di tutti componenti del gruppo o del singolo concorrente",
2) "l'elenco delle principali opere e/o progetti più rappresentativi con particolare riferimento al tema del concorso" ?

- Coloro che hanno rapporti di lavoro dipendente con enti, istituti o amministrazioni pubbliche potranno partecipare al concorso solo se autorizzati.
- E' compito del costituendo gruppo di progetto verificare sotto la propria responsabilità, il ruolo e la posizione delle figure nei confronti dei requisiti richiesti alla partecipazione al concorso, la documentazione da presentare infatti (Allegati B e C) è stata redatta sotto forma di dichiarazione.

Quesito 50

- Quali di questi adempimenti sono obbligatori perché un professionista abilitato da meno di cinque anni sia ammesso all'iscrizione in un RTP?
- Il professionista abilitato da meno di cinque anni può svolgere anche l'incarico di capogruppo?
- Ai sensi dell'ultimo periodo del comma 7 dell'art. 90 del codice degli appalti il soggetto affidatario dell'incarico deve dimostrare la propria regolarità contributiva, in che fase del concorso?
- Come fanno i professionisti europei o extraeuropei a dimostrare la propria regolarità contributiva?

- Per essere abilitati all'esercizio della professione, il professionista deve essere iscritto all'ordine professionale.
- Il professionista laureato abilitato da meno di cinque anni all'esercizio della professione può svolgere il ruolo di capogruppo.
- Il soggetto affidatario dell'incarico deve dimostrare la propria regolarità contributiva, al momento della stesura della graduatoria finale del concorso. La verifica avverrà a cura dell’amministrazione, dopo l'affidamento provvisorio e prima dell’affidamento definitivo.
- Sarà cura dell’amministrazione richiedere ad ogni soggetto la documentazione necessaria a tale scopo.

Quesito 51

Considerato che il punteggio viene attribuito in base ai parametri A1 A2 e A3 definiti all'art. 3.3 del bando e che al punto A2 si attribuisce il punteggio in base all "articolazione del gruppo di progetto". Gli eventuali consulenti non progettisti verranno valutati anche se non sono effettivamente all'interno del gruppo presentato?

Quesito 52

Un designer e un'artista possono essere considerati come progettisti all'interno dell'RTP? L'iscrizione ad associazione come ADI (Associazione Disegno Industriale e relative associazione straniere) sono titolo sufficiente (insieme alla laurea) per essere considerati abilitati?

E' compito del costituendo gruppo di progetto verificare sotto la propria responsabilità, il ruolo e la posizione delle figure professionali nei confronti dei requisiti richiesti alla partecipazione al concorso. I professionisti che verranno individuati a formare il gruppo di progetto, dovranno essere abilitati a firmare il progetto, parti di esso di loro competenza, o quantomeno gli studi e le indagini che fanno parte del progetto stesso. Vi invito quindi a consultare l'art. 90 del D.Lgs 163/2006. Da come è stato formulato il quesito si ritiene che l'artista ed il designer debbano far parte dei consulenti o collaboratori, in particolare per quanto riguarda il designer possiamo consigliare di verificare eventuali equipollenze, se esistono, con i titoli di studio che consentono di sottoscrivere il progetto come dettato dall'articolo del codice degli appalti citato.

Nella domanda di partecipazione e nell'autocertificazione è richiesta una PEC. Come ci si deve comportare nel caso della partecipazione di professionisti della UE per i quali la loro legislazione non prevede l'obbligo di dotarsi di essa?

1. Vista l'indicazione esplicita della non possibilità di modificare il gruppo di progettazione nelle eventuali fasi successive al preliminare, esistono figure professionali la cui presenza è obbligatoria? Tali figure possono essere inserite come consulenti?
2. È altresì possibile aggiungere consulenti o consulenze esterne in fasi successive a quelle di preselezione, pur mantenendo invariato il Gruppo di Progettazione?

1. Il bando di concorso non richiede specifiche professionalità per la formazione del gruppo di progetto, né per quelle riferite ai consulenti e ai collaboratori. L'art. 2.3 del bando di concorso chiarisce quanto da lei sollevato.
2. Fermo restando che il soggetto giuridico che partecipa al concorso non potrà essere modificato; fermo anche l'assunto generale che il gruppo costituito dovrà essere in grado di redigere compiutamente e sottoscrivere il progetto de "Il parco centrale di Prato", si fa presente che, nel caso di necessità di integrazioni tecniche di tipo specialistico, il gruppo di progettazione può affidare incarichi specifici a professionisti esterni ad esso, al fine di affrontare le tematiche emerse. Tali incarichi saranno a totale carico e sotto la diretta responsabilità del soggetto giuridico che ha vinto il concorso e dovranno essere sottoscritti da chi materialmente ha redatto l'integrazione tecnica e dal capogruppo del team costituito.

3. Se la partecipazione al concorso avviene da un'unica società, il legale rappresentante coincide con il capogruppo. Se invece partecipano più società ed anche dei singoli professionisti, l'allegato B indicherà il capogruppo prescelto.
4. Il documento che certifica il raggruppamento temporaneo di professionisti dovrà essere fornito in forma cartacea nella busta A "DOCUMENTAZIONE AMMINISTRATIVA".

Nella fase di preselezione, la commissione non utilizzerà il metodo di riparametrazione per la selezione dei concorrenti da ammettere alla fase successiva, ma la semplice somma dei punteggi attribuiti discrezionalmente sulla base dei criteri indicati all’art. 3.3 del bando.

In the preselection phase, the jury will not adopt a method of different parameterization to select the candidates to be admitted to the competition phase, the selection will simply be based upon the arithmetic sum of the points assigned by the jury, based on the criteria outlined at point 3.3 of the competition notice.

2. In caso di risposta positiva alla precedente domanda, il capogruppo in questione dovrà corrispondere con il rappresentante dell'ATI che si andrà a formare in caso di ammissione al concorso?

2. Si tratta di un concorso di progettazione, le funzioni del futuro edificio non sono definite.
3. Posso dirle che almeno all'attualità, sarà il comune di Prato il futuro gestore del parco.
4. Certamente, il gruppo di progetto che vincerà il concorso avrà l'incarico di redigere il progetto definitivo ed esecutivo del parco, dove gli aspetti da lei sollevati, ne sono parte. Le consiglio comunque di visionare con attenzione tutti i documenti pubblicati sul sito istituzionale dell'ente e sul sito www.ilparcocentralediprato.it.

We are an engineering company and we are interested in participating in the competition by teaming up with another company. Since Appendix B and C only require that we indicate the NAME and LAST NAME of the professionals, how should we indicate the NAMES of the two companies that are participating?

Nel caso di due professionisti che lavorano spesso, su alcuni progetti, in partnership come co-autori, possono partecipare al concorso "Il Parco Centrale di Prato" come coordinatori del gruppo? Oppure è obbligatorio designare un unico coordinatore, nel caso appunto di raggruppamento temporaneo di professionisti?

1. Le opere di demolizione sono escluse dalla progettazione e dai costi di esecuzione.
2. Fermo restando che il soggetto giuridico che partecipa al concorso non potrà essere modificato; fermo anche l'assunto generale che il gruppo costituito dovrà essere in grado di redigere compiutamente e sottoscrivere il progetto de "Il parco centrale di Prato", si fa presente che, nel caso di necessità di integrazioni tecniche di tipo specialistico, il gruppo di progettazione può affidare incarichi specifici a professionisti esterni ad esso, al fine di affrontare le tematiche emerse. 4. L'allegato C, nel caso di raggruppamento temporaneo già costituito, deve essere compilato dal solo mandatario e capogruppo del team di progetto. I consulenti e collaboratori riempiranno le parti a loro dedicate nell'allegato B.
5. Per la nomina del capogruppo è sufficiente la firma.
6. È sufficiente leggere l'art. 3.2 del bando di concorso.
7. BUSTA A "DOCUMENTAZIONE AMMINISTRATIVA". BUSTA B "DOSSIER DI PRESENTAZIONE", come indicato nell'art. 3 del bando.
8. Si tratta di un concorso di progettazione i cui obiettivi materiali e strategici sono descritti nel DPP allegato al bando.

All participants who do not belong to member states of the EU need to be qualified in the country to which they belong. They will have to make a commitment to form a temporary consortium with a professional who is a citizen of the EU and who will be the group leader. All documentation necessary for the preselection must be mailed, in hardcopy, to the Ufficio Protocollo of the Comune di Prato, as per modes of delivery defined in the competition notice, on pain of exclusion. The documentation may not be submitted via email, the hardcopy to follow thereafter.

Nel DPP Documento Preliminare alla Progettazione affermate: il progetto del nuovo parco prevede due lotti funzionali. il primo comprende la completa realizzazione delle aree verdi e quindi del parco, oltre a un volume della superficie minima di 500 mq di Sul che contenga, tra le altre cose, i servizi essenziali al parco stesso. il secondo lotto funzionale prevede la realizzazione degli altri fabbricati, fino alla concorrenza della Sul massima prevista dalla variante urbanistica adottata con Dcc 63/2015, che ammonta a 3.000 mq di Sul e che sarà gestita con altre procedure amministrative. Il progetto del primo lotto dovrà dunque prevedere anche l’inserimento degli edifici del secondo lotto che, conseguentemente, dovranno essere integrati dal punto di vista spaziale, architettonico e concettuale nel progetto del parco. Esistono dei requisiti specifici per gli edifici previsti dai due lotti funzionali? Tali requisiti saranno specificati nel contratto per la loro progettazione successiva? Il costo degli edifici è compreso all'interno del bilancio fornito?

Further to my previous email could you please clarify the following. In PPD Preliminary Planning Document abstract you state: The project for the new park consists of two functional lots. The first includes the complete creation of the green areas and therefore of the park, as well as a built volume with a minimum area of 500 square meter of gross floor area containing, among other things, the services essential to the park itself. The second functional lot includes the creation of other buildings, up to the extent of the maximum GFA provided for in the town planning variation adopted with Town Council Resolution 63/2015, which amounts to 3,000 square meters of GFA, and which will be managed with other administrative procedures. The design of the first lot must therefore also plan for the inclusion of the buildings of the second lot which, as a result, must be integrated into the park design from a spatial, architectural and conceptual perspective.
Is there any specific program requirements for the buildings that will need to be included within two functional lots? Will it be part of contract to design them? If so is the cost of the buildings included within the budget provided?

Il bando di concorso non definisce le caratteristiche del progetto ma fornisce, all'interno del DPP, tutte le informazioni necessarie per redigerlo nella forma pari ad un progetto preliminare, che è appunto l'obiettivo del concorso. La progettazione definitiva ed esecutiva successiva, completerà il progetto di tutti gli elaborati, studi e quanto altro necessario per porre il progetto a base di gara per la realizzazione de “Il parco centrale di Prato”. Il costo degli edifici del primo e del secondo lotto è esplicitato all'interno del bilancio fornito.

The competition notice does not define the characteristics of the project, but the PPD provide all necessary information to draft it in the form of a schematic design, which is the very objective of the competition. The subsequent phases of final and detailed design will complete the project with all documentations, surveys and all other necessary information for the Municipality of Prato to set a call for tenders to realize “Il Parco Centrale di Prato”. The costs of the buildings in the first and in the second lot is described in the Financial framework.

Trattandosi di un concorso di progettazione le caratteristiche dei professionisti individuati a formare il raggruppamento, dovranno essere adeguate al tipo di progetto che verrà proposto. Le figure professionali che i partecipanti al concorso individueranno, dovranno quindi essere abilitate a firmare il progetto, parti di esso di loro competenza, o quantomeno gli studi e le indagini che fanno parte del progetto stesso. Professionisti che non possiedono tali abilitazioni, potranno figurare come consulenti o collaboratori ai sensi di quanto previsto dal punto 2.3 del bando. Nella fattispecie si ritiene che un libero professionista laureato in agraria possa firmare le parti del progetto di propria competenza e possa, conseguentemente, figurare come capogruppo.

Since this is a design competition, the expertise of the professionals part the consortium will fit the kind of project that will be submitted. Such professionals must hence be qualified to seal or stamp the project, or those parts of the project that concern them, or at least the surveys and investigations that are part of the project itself. Professionals who are not qualified in this sense may still be consultants or collaborators, as per point 2.3 of the competition notice. To more specifically answer this question, a professional with a degree in agronomy can seal or stamp those parts of the project that concern him and may, therefore, also be the group leader.
